CRJU 310 Judge Oberholzer April 12, 2009 Mapp v. Ohio * Mapp v. Ohio * 367 U. S. 643 * (1961) * Character of Action Mrs. Mapp was found guilty and sentenced to prison 1-7 years. Mrs. Mapp and her attorney took the case to the Supreme Court in Ohio. * Facts: Three police officers went to Dollree Mapp’s house asking permission to enter into her house, because they believed that she was hiding a fugitive in her home. When she did not allow the police officers into her home, the police officers left and came back three hours later with a search warrant. When Ms. Mapp asked the police officer if she could see the warrant, he held up a piece of paper that was believed to be a fake warrant. The police officer handcuffed Ms. Mapp for â€Å"resisting arrest†. As the police officers looked around her house, they did not find any fugitive but they did find pornographic material in a suitcase that was by Mrs. Mapp’s bed. Mrs. Mapp told the police officers that the pornographic material was not hers but that it belonged to another individual that she had loaned the suitcase too. Mrs. Mapp was arrested, found guilty and sentenced for having pornographic material. * Issues: A. Was the issuance of the warrant by the police officer invalid in violation of the Fourth and Fourteenth Amendments? YES. B. In the absence of a warrant, may a search and seizure take place in a person’s home without their consent? NO. C. Is evidence obtained, without a warrant, from voluntary submission of a third party inadmissible in a court of law in violation of the Fourth and Fourteenth Amendments? NO. * Decision: The Court held that the exclusionary rule, which prevents unconstitutionally btained evidence from being introduced at trial, applies to states as well as to the federal government. * Majority Opinion: (by Justice Clark) Issue (A) — Yes. Reasons: i. The Fourteenth Amendment requires that a â€Å"neutral and detached magistrate† must issue a warrant. ii. Justice Clark declared, â€Å"The exclusionary rule should also apply to states, saying that states are not permitted to use evidence gained by illegal means to convict a person. With a 6-3 vote of approval, Mapp's case was overturned and the law was forever changed†. Issue (B) — No. Reasons: i. Justice Clark declared, â€Å"We hold that all evidence obtained by searches and seizures in violation of the Constitution [is] inadmissible in a state court†¦ Were it otherwise†¦ the assurance against unreasonable†¦ searches and seizures would be [meaningless]†. Mrs. Mapp at the time of her arrest was not issue a warrant just a piece of paper. The police officers still searched her house without her consent. 09. Concerning Opinion: by (Justice Black) Justice Black shares the doubt that â€Å"The Fourth Amendment alone can be used to prevent illegally obtained evidence from being used in state courts because it is not explicitly stated. Justice Black also believes the command that no unreasonable searches or seizures be allowed is too little to infer such a large decision. With these differences aside Justice Black feels that along with previous court decisions that the â€Å"Fourth Amendment's ban against unreasonable searches and seizures is considered together with the Fifth Amendment's ban against compelled self-incrimination, a constitutional basis emerges which not only justifies, but actually requires the exclusionary rule. Concurring/Dissenting Opinion: (by Justice Clark, whom the Chief Justice joins) These two justices, Clark and Brennan came to an agreement with Mrs. Mapp that her rights as a citizen of the United States were violated. Both Justices used the Fourth Amendment and that is evidence obtained in violation of the Fourth Amendment, which protects against â€Å"unreasonable searches and seizures†, may not be used in criminal prosecutions in state courts, as well as federal courts. Concurri ng/Dissenting Opinion: (by Chief Black) Justice Black found that the case was a combination of the Fourth and Fifth Amendment and not with the Fourteenth Amendment. Justice Black turned out to be the swing vote. Even though, he joined the Court’s opinion he did it for his own reasons. For the reason, Justice Black wrote a separate opinion that was not joined by any other justice. Concurring/Dissenting Opinion: (by Justice Stewart) Justice Stewart wrote the majority opinion in Elkins. Yet, he refused to join the Court’s opinion. He did vote with the majority to reverse Mrs. Mapp’s conviction. 10. Comment: Mapp v. Ohio is an important case that made history. For the reason it has to do the Fourth and Fourteenth Amendment. All evidence obtained by searches and seizures in violation of the Federal Constitution is inadmissible in a criminal trial in a state court. Wolf v. Colorado, 338 U. S. 25, overruled insofar as it holds to the contrary. Pp. 367 U. S. 643-660. (A) A warrant must be issued by a â€Å"neutral and detached magistrate† who is not involved in either the investigation or prosecution of the suspect upon whom such a warrant is issued (Harvard Law Review, Vol. 5(3), 1971, pp. 239-250). (B) At the trial, no search warrant was produced by the prosecution, nor was the failure to produce one explained or accounted for. At best, â€Å"There is, in the record, considerable doubt as to whether there ever was any warrant for the search of defendant's home. † 170 Ohio St. at 430, 166 N. E. 2d at 389. The Ohio Supreme Court believed a â€Å"reasonable argument† coul d be made that the conviction should be reversed â€Å"because the methods' employed to obtain the [evidence] . . . here such as to `offend â€Å"a sense of justice,†Ã¢â‚¬ËœÃ¢â‚¬  but the court found determinative the fact that the evidence had not been taken â€Å"from defendant's person by the use of brutal or offensive physical force against defendant. † 170 Ohio St. at 431, 166 N. E. 2d at 389-390. Mrs. Mapp took a stand against the police officers because she felt she was doing nothing wrong. The police officers assumed that Mrs. Mapp was involved in hiding a fugitive as well as in hiding some illegal betting equipment. When the police officers got to Mrs. Mapp’s house they asked to go in she said â€Å"no†. Three hours later the police officers came back with a piece of paper (not a search warrant) when Mrs. Mapp asked to see the warrant she had to struggle to get it. The judges overturned the conviction because the police officers had violated the fourth Amendment. 11. Principle of the Case: A warrant issued by any public official, other than â€Å"neutral and detached magistrate† is invalid in violation of the Fourth and Fourteenth Amendments. A person’s home cannot be searched without their consent or without a search warrant.

Jespersen vs. Harrahs Case Analysis Essay

Facts: Darlene Jespersen was a bartender at Harrah’s Casino in Reno in the sports bar. She was frequently praised by her supervisors and customers for being an outstanding employee. When Jespersen first started her job at Harrah’s the female bartenders were not required to wear makeup but were encouraged to. Jespersen tried to wear makeup to work a few times but decided that she did not like it due to the fact it made her feel sick, degraded, exposed and violated. She also believed that it interfered with her ability to deal with unruly customers because it â€Å"took away [her] credibility as an individual and as a person.† After 20 years of working for the company, Harrah’s implemented the â€Å"Personal Best† program contained certain appearance standards that applied equally to men and women. Women were now required to wear makeup and when Jespersen refused, she was fired. Jespersen sued Harrah’s under Title VII. Argument for Jespersen: Jespersen refused to wear makeup to work because the cost-in time, money and personal dignity. Under Title VII of the Civil Rights Acts of 1964 employers are free to adopt different appearance standards for each sex, but these standards may not impose a greater burden on one sex than the other. Women were required to wear makeup and men were not which allowed men to save hundreds of dollars and hours of time. Harrah’s had no right to fire Jespersen because the rule only applied to women. Argument for Harrah’s: Employers are allowed to impose different appearance rules on women than men as long as the overall burden upon the employees is the same. Harrah’s rules did not impose a heavier burden on women than on men. Outcome: Jespersen appealed the judgment of the United States District Court for District of Nevada granting defendant employer summary judgment in the employee’s sex discrimination action filed under Title VII of the Civil Rights Act of 1964. The final outcome was that the original judgment granting Harrah’s summary judgment was affirmed because Jespersen failed to present sufficient evidence to survive summary judgment on her claim. My Opinion: I agree with the final outcome of this case. Jespersen did not have enough evidence to prove that by Harrah’s requiring her to wear makeup was indeed sexual stereotyping. The â€Å"Personal Best† program had plenty of restrictions and requirements for men as well as women.

Cultural Text Analysis Essay

Cultural texts can be described by Vanhoozer et al, as any work that is done by human beings that has a meaning because it is done intentionally and not as a fluke or by reflex. They include newspaper articles, books and other printed material, objects, images, spaces, films and music (Vanhoozer et al. , 2007, p. 248). There are a number of aspects of the English language (figures of speech) that are used in the writing of cultural texts to make the language use in the texts flowery, or even to explain some things in a deeper manner. They are also used to show the emotional intensity or to explicitly show the writer’s sense impressions by comparing one thing with another that is common or well known to the reader. Some examples of these are the use of metonyms, metaphors and connotations. A metonym can be defined as the usage of a word in a text to denote one thing while in actual fact; the word refers to a related thing. It can also be described as a situation where a word is replaced with another one that is closely associated with it (Casnig, 2009). An example of a metonym is the way people say plastic to mean credit cards or the way they say Washington, while what they actually mean to refer to is the United States Government. A metaphor on the other hand is defined as the comparing of two things without using words ‘like’ or ‘as’. They are a good way to put an image into the mind of the reader in regards to the message that they are trying to convey. Improper use however could mean that the message that the writer is trying to convey will not be understood properly (Wheeler English, 2010). An example when it comes to its use is when used in a sentence, when somebody says, â€Å"†¦her hair is snow white. † Here, the color of hair is being compared to the color of the snow, but there is no use of the words ‘like’ or ‘as’, and thus this makes the expression a metaphor. When it comes to connotations, these are ideas that are implied or suggested. They refer to the connections or associations that are connected to certain words or even the emotional suggestions that are related to the word in question (Word Reference. com, 2010). An example of this could be the way the word snake if used in reference to a person could be used to mean that the person is evil or dangerous. It could also mean that the person is crafty and not open and honest in their dealings with people. The cultural texts that I am going to use to show how metonyms, metaphors and connotations have been used are: a film on Eyes on the Prize Interviews. The specific interview in this case is the Rosa Parks interview that was done on November 14, 1985, and was produced by Blackside Inc. The interview was gathered as part of Eyes on the Prize: America’s Civil Rights Years (1954-1965). The second cultural text will be an article titled â€Å"Walking while Muslim† which is an article that was written in the year 2005 by Margaret Chon and Donna E. Arzt. Finally, I am also going to look at Everyday Theology: How to Read Cultural Texts and Interpret Trends which is a book written by Kevin J. Vanhoozer, Charles A. Anderson and Michael J. Sleasman. In the film on an interview with Rosa Parks, examples of metonyms that have been used are: when she is asked by the interviewer about how segregated their area was, she says, â€Å"In 1954, after the Supreme Court decision had been handed down to do away with uh, segregation in the public schools†¦Ã¢â‚¬ . Here, Supreme Court is a metonym for judges or juries, because in actual fact, they are the ones that make rulings in court. Another example is when Rosa Parks refers to the bus as being ‘packed’, which is a metonym for full, or filled to capacity. When it comes to connotations, an example of one is when the interviewer asks her, â€Å"How did you feel about sparking the boycott†¦? † The word spark here is used to mean that she was the one who agitated or stirred the people into action. Another connotation is when she refers to people as blacks and whites in her interview. This is a connotation of the African Americans and the American people (Washington University Film and Media Archive, 1985). In the article, â€Å"Walking while Muslim†, there are also some figures of speech that have been used in its content. Examples here are the use of connotations where it is said that the United Nations standing committee is toothless. What this means is that they have no power in terms of the functions that they are allowed to carry out. It is also shown when it is said that the international human rights enforcement systems are expected to have a better track record than the UN in the protection of human rights. The phrase track record is used here to refer to the record of their actual performance and accomplishments. This is because in the literal sense, track record means a documentation of speeds that an athlete runs or has been running over a period of time. Metaphors have also been used where the International Human Rights law is being likened to a guardian of religion. Here, the law and guardian have been compared without the use of ‘as’ or ‘like’. There is also an example of a connotation where they say that Jihad is one of the Islamic beliefs that are perceived as religious zealotry directed at non-Muslims. The word Jihad here is used as a connotation of the violent aggression of Muslims towards non-Muslims or secular people (Chon, M. and Arzt, D. , 2005). In the book, Everyday Theology: How to Read Cultural Texts and Interpret Trends, figures of speech have also been used in this context. Examples of some of these are: one of the characters in the book, Kevin Warwick—a leading researcher and professor of cybernetics at the University of Reading, says he is a cyborg. This is a metaphor because he is comparing himself to a being that is part human, part machine. In the book also, there is also a section where biotechnology is likened to a savior, and also where we are told that we should offer ourselves as living sacrifices. In this case, we are being directly compared to sacrifices (animals that are usually offered to God in order to appease him or thank him for something). There is also the use of metonyms where it says that â€Å"whatever label we choose to wear,† referring to the title that we choose to have because in actual fact, we cannot wear a label. Another metonym that I have discovered is when the author says that as Christians, they may fail to see the way the world looks at those who believe that the present is all that there is. Here, the ‘world’ does not refer to the physical globe, but to the people who are non-believers. Our paper discusses an important step in the research surrounding stem cells. Pluripotent stem cells are found in the early blastocyst, and can differentiate into different cell types such as neurons, cardiac muscle, or blood cells. As is explained elsewhere on this paper, stem cells are extremely useful and hold amazing medical potential, especially to â€Å"grow† specific cells, tissues, and even organs for patients. Controversy mires the progress of stem cell research from embryos, however, and technical problems exist along with the ethical ones. Marius Wernig and his team of scientists have had success studying a way to get around this, however. What if, instead of taking stem cells from newly created embryos, an individual’s own cells could be used? The cells in the adult body are no longer stem cells; they aren’t pluripotent, and can only be a certain type. But with special techniques, it’s actually possible to induce these adult cells to become stem cells, with a pluripotency that allows them to develop into whatever cell type is needed! In this experiment, induced pluripotent stem cells were created using the fibroblast cells from mice. Fibroblasts were removed from underneath the skin of the subject mice. In order to revert the cell back to a induced pluripotent state, four specially selected transcription factors (Oct 4, Sox 2, c-Myc and Klf4) were used. These four transcription factors were each incorporated into the DNA of a virus that lacked the capacity to infect, and the fibroblasts were exposed to these viruses. Just like normal viruses, these injected their DNA into the fibroblast cells, and the DNA was incorporated into the cell. The History of Coca-Cola The Coca-Cola company started out as an insignificant one man business and over the last one hundred and ten years it has grown into one of the largest companies in the world. The first operator of the company was Dr. John Pemberton and the current operator is Roberto Goizueta. Without societies help, Coca-Cola could not have become over a 50 billion dollar business. Coca-Cola was invented by Dr. John Pemberton, an Atlanta pharmacist. He concocted the formula in a three legged brass kettle in his backyard on May 8, 1886. Coca-Cola debuted in Atlanta’s largest pharmacy, Jacob’s Pharmacy, as a five cent non-carbonated beverage. Later on, the carbonated water was added to the syrup to make the beverage that we know today as Coca-Cola. Coca-Cola was originally used as a nerve and brain tonic and a medical elixir. Coca-Cola was named by Frank Robinson, one of Pemberton’s close friends, he also penned the famous Coca-Cola logo in unique script. Dr. John Pemberton sold a portion of the Coca-Cola company to Asa Candler, after Pemberton’s death the remainder was sold to Candler. Pemberton was forced to sell because he was in a state of poor health and was in debt. He had paid $76.96 for advertising, but he only made $50.00 in profits. Candler acquired the whole company for $2,300(Coca-Cola multiple pages). Candler achieved a lot during his time as owner of the company. On January 31, 1893, the famous Coca-Cola formula was patented. He also opened the first syrup manufacturing plant in 1884. His great achievement was large scale bottling of Coca-Cola in 1899. In 1915, The Root Glass Company made the contour bottle for the Coca-Cola company. Candler aggressively advertised Coca-Cola in newspapers and on billboards. In the newspapers, he would give away coupons for a free Coke at any fountain. Coca-Cola was sold after the Prohibition Era to Ernest Woodruff for 25 million dollars. He gave Coca-Cola to his son, Robert Woodruff, who would be president for six decades(Facts, Figures, and Features Multiple pages). Robert Woodruff was an influential man in Atlanta because of his contributions to area colleges, universities, businesses and organizations. When he made a contribution, he would never leave his name, this is how he became to be known as "Mr. Anonymous." Woodruff introduced the six bottle carton in 1923.

In this essay I will be exploring how the poets expressed their views in a strong and effective way. I shall be writing about three poems. †¢ Base Details by Siegfried Sassoon †¢ On the life of man by Walter Raleigh †¢ Those bastards in their mansions by Simon Armitage Base Details Siegfried Sassoon In this essay I will be describing the contrasts and explore the attitude of the poet in a strong and effective way. This poem is written by Siegfried Sassoon, who was a soldier during the First World War. He used the majors and the soldiers as protagonists of this poem.The poet has described the physical attributes of the majors who would stay at the base, because they were fat, short of breath. Siegfried uses number of abusive and mockery words to describe their behaviour towards one another. In the beginning of the poem the poet says that he’d live in with the majors at the base. He used abusive and mockery words to describe the physical attributes they posses. Th e poet says that â€Å"Bald†, â€Å"short of breath† and â€Å"scarlet†. The word â€Å"bald† means that they didn’t have any hair on their head, and â€Å"short of breath† refers towards their shape and body figure.The lexis† scarlet† has a lot of meanings, but in their case it means that they were guilty. The majors were the main reason for the death of the soldiers. These three words highlight the characteristics of them, as well as it was mentioned in the first two lines of the poem. Afterwards, Siegfried immediately talks about the soldiers whose fate was inevitably a fateful misery. The author observes the fact that, they were active and they used to get forced towards the frontline. This is evidenced from the poem he states that: – â€Å"And speed glum heroes up the line to death†.Nevertheless, since they met their fate bravely and gave their life in the war, this made them a true hero. Additionally, the poet goes back to the description of the major’s actions. So the poet uses the word â€Å"Guzzle† and â€Å"Gulp† in the â€Å"best hotel†. In this context the poet describes that the poet himself and the majors would eat and drink in an excessive manner. Therefore the word â€Å"guzzle† means to eat in an excessive manner, and the word â€Å"gulp† to drink in an excessive manner as it makes a gulping sound, therefore the poet used them two word to make it effective.Moreover, since the war is still happening the majors would continuously eat and drink. To such an extent that the poet has described their faces as â€Å"Puffy† and â€Å"petulant†, the poet has used the mockery words again to describe the majors. The word â€Å"puffy† means that they would be fat and â€Å"petulant† means to be swollen. Afterwards he uses the sarcasm attitude towards the soldiers by stating: – â€Å"Poor young chap, Roll of Honou r is an alliteration which the poet has used. I’d say†.He’d say â€Å"poor young chap† to show their grief towards the soldiers, and â€Å"Roll of Honour† is a faceless list of names of the soldiers. In reality the majors weren’t really cared for them whilst they were burying the soldiers. Nevertheless, after burying them they would continue their sarcastic conversations about their innocent soldiers. Siegfried proofs this from the poem he says that â€Å"I’d say I used to know his father well; yes, we’ve lost heavily in this scrap†. This shows up their fake and strong relationship between them. He also mentions the word â€Å"scrap† to describe the war.The majors would describe this war as a scrap. This war means nothing to them, regardless they’ve lost heavily amount of soldiers. This part of the poem is a technique of euphemisms. This war was like a board games, how a player would sacrifice a counter to g ain victory. In conclusion, the poet gives a scenario or a clear contrast of the soldiers and the majors. They’d be scattered everywhere. I mean that the majors would â€Å"toddle† due to their fat and overeating. Therefore they’d walk slowly and safely, since they are not at the battlefield.On the other side, the soldiers would be â€Å"stone dead†; this means that they would be still dead at the battlefield. Finally, the rhyming scheme of this poem is (ab, ab, cd, ee,). Also the last two lines of this poem is known as† Rhyming Couplet†. Since they rhyme at the end and those two words are â€Å"dead† and â€Å"bed†. Those Bastards in their mansions Simon Armitage This poem is written by Simon Armitage, he has dedicated this poem towards the poor people, and this poem is from the collection of ‘taking a stand’. This poem features the division between the poor and the rich.Simon Armitage is totally against it; therefo re he is taking a stand protecting the poor from the rich. Thus, I will be explaining this poem. Firstly, the author is referring the rich people as ‘bastards’ which is on the first line of the poem, because if there was to be a poor walking in front of their house they would ask each other â€Å"who is he? †, â€Å"why is he dressed in that manner? † where is he from? † etc. That’s why the author referred them as ‘bastards’. In this situation the rich people would be alarmed and clutch their possessions closer.After while, he says that he would save the poor masses and protect them from different kind of destruction, and bring them a form of benefit. â€Å"I’d poisoned the dogs and vaulted the ditches† gives a form of proof from the poem itself. Moreover, there state is really ragged because not only there’s a division between them, the poor people would also get oppressed by the rich. Thus, Simon Armitage de cides to break through the front door, it is also evidenced form the fifth line of first stanza, so that he would bring them benefit.This is clearly observed in line six. † The gift of fire from the burning torches. These properties are like gift thus he used the word ‘gift’ to show the preciousness of it. This part of the poem refers towards the Greek mythology about Prometheus and Zeus. Prometheus was Greek God and also the first god to create human beings. Not only that he stole fire from Zeus and distributed it towards the whole of humanity. Zeus became really furious, upon knowing that Prometheus gave a precious element to the mankind.Therefore, Zeus punished Prometheus by chaining him to the peak of a mountain, so that everyday eagles would peck from his liver. Since, Prometheus was immortal each night his liver would grow back. Nevertheless, after distributing the properties he would teach them how to get rid off themselves from the great oppression and how to take a stand against the cruelty of the rich. Thereafter, since they don’t have any weapons to face against the rich, what they would do is that they would use the same chains and shackles which they were tied by.They use those chains to take a stand against the rich and break the division of the privileged ones and the non-privileged ones. In conclusion, the poet is alarming himself bravely in the second line of third stanza that â€Å"they’d have me sniffed out by their beagles†. Simon speaks regarding their troops of dogs, which the rich would keep to guard their properties. Since in the beginning of the poem talks about poisoning the dogs, therefore the dogs certainly will be able to catch and he’ll get imprisoned as well as face other severe consequences.But on the last stanza he says that â€Å"me, I stick to the shadows carry a gun†, here the poet clearly and bravely shows himself that he’s fearless and he’d hide himself fr om those bastards in their mansions. On the life of Man Sir Walter Raleigh This poem has been written about the life, by using extended metaphor throughout the poem. It also gives a bit of idea by looking at its title. It has been written by Sir Walter Raleigh. He has expressed his attitude and his views towards this life as a form of ‘Sacrifice’. There are other numerous views regarding this life.I will be exploring his attitude in a strong and effective way. In the beginning, Sir Walter Raleigh asks a rhetorical question that â€Å"What is Life†. Then he gives immediate response by saying â€Å"A play of Passion†. The word â€Å" play† is referring towards the life, meaning that how it works or it carries on etc. in this context it is blatantly giving the indication towards a theatre play. The poet has used the theatre play to show the example of life. Then he tells the situation of life, therefore he says his opinion upon saying the word â€Å"p assion†.Passion is giving the meaning of going through strong emotions and lot of sacrifices. There are many people who’d go through sacrifices in their life. The most famous example is Christ, who went through lot sacrifices, to such an extent that he died to take away his people’s sins. Later on, he states that there is a small amount of laughter or amusements takes place in our life. He compares this amusement as a small amount of time. Therefore, he says that â€Å"Our mirth the music of division. † He indicates this back to the play, this shows that when all the actors go for a short interval.Whilst some orchestra will appear on the stage to entertain the audiences as well as some will eat, talk, or go to the toilet. This is done so that they can split up the acts. Additionally, the poet talks about the beginning of life. He takes the human beings as actors and a place where they would get dressed. He states â€Å"Our mother’s womb the tiring houses can be†. He uses the word â€Å"womb† to link it towards the green room, and then the poet elaborates more about this point to show what happens. He states further upon saying â€Å"Where we are dressed for this short comedy†.Sir Walter supports the view of life as short progression of time; therefore he has mentioned the word â€Å"short† as well as â€Å"comedy†. The word â€Å"comedy† refers towards a play which ends happily. Moreover, Sir Walter Raleigh identifies a link of life with God. He asserts that God is watching us sharply, thus he quotes â€Å"Heaven the judicious sharp spectator is†, he is using metaphor to make God as our audience. The poet strongly believes that he will get accounted for whatever he does in this life. Therefore, he explains further that god is looking over us continuously and judging us according to our actions.He says â€Å"That sits and marks still who doth act amiss†. Meanwhile, the aut hor describes the grave where everyone will end up at the end of their life. He quotes† our graves that hide us from the searching Sun†. The poet is using the word â€Å"hide† to show that the earth will be filled over us. He uses metaphor of the stage again, like the way he has mentioned at the beginning. He gives an example on saying that â€Å" Are like drawn curtains that when the play gets done the curtain draws close, exactly the same way a life of a person ends by filling earth over him/her.Finally, the poet ends this poem describing the progression of time. He states â€Å"thus march we playing to our latest rest†. The word â€Å"rest† shows that they’ll be in luxury in the next world, since a person has sacrificed or take this life as strong emotions. It also show that the poet is being theist based on this fact. Then on the last line he says â€Å"only we die in earnest and, that’s no jest†. He is referring towards the poem once more that, this life is nothing or it has no value to him. Therefore, he has mentioned the word â€Å"earnest† and â€Å"jest† to show that we truly die and that’s no joke nor it’s fake.

Second Language Acquisition and Bilingualism

In America, there is a predominant growth in multiple ethnicities and cultural backgrounds; leading to the usage of multiple languages in the American culture. There is a growing need for many people to learn and utilize multiple languages within the workplace and within one's own personal life. The importance of bilingualism and the knowledge of multiple languages is ever increasing, and therefore becoming more important for the younger generations. The push for knowing multiple languages and becoming bilingual has many potential negative and positive effects. Bilingualism is the ability to use two languages when communicating orally or in writing. The usage of multiple languages within the American culture is becoming very common and beneficial. It is difficult because as teacher you always have to find new and interesting methods in order to arouse learner’s interest, but at the same time it is enjoyable since teachers are given the opportunity to work with them. For myself, I enjoy working with bilingual children; I as a caregiver try to learn the students’ first language so that I will be able to communicate with them as much as possible in their native language. Currently in my classroom I have a German native. His name is Lucas and he is fifteen months old. His mother is German and his father is an American soldier. Both of his parents speak English and German. So at home they communicate with him in both languages. I talk to his mother and father on a daily basis to find out new words in German so that I can talk to him in both languages. I have discovered that some words that I do say in German he really does respond to them better, than if I would tell him to do something in English. Second language acquisition is the process of learning other languages in addition to the native language. Second language acquisition is a long process which can include many stages. For instance, a child who speaks German as the mother tongue starts learning English when he/she starts going to school. English is learned by the process of second language acquisition. Students of second language acquisition go through the same stages of learning, the period of learning varies. Some students tend to learn better by responding to visuals and pictures. There are many positive benefits in the acquisition of a second language and bilingualism. There are many positive affective factors for second language acquisition and bilingualism. Some positive factors can be listed as: the student’s attitude towards learning the new language, the teacher motivational attitude, and the proficiency in the student’s first language. Also learning a second language at an early age can have a positive effect on intellectual growth, and also enhance and enrich the child’s mental and development. Furthermore it can open the doors of opportunities to other cultures and help the children learn and appreciate other people from other countries. There are two types of bilingualism. The first type is simultaneous bilingualism. Simultaneous bilingualism is when children acquire two languages prior to the age three. Simultaneous bilingualism normally happens when the language used at home is different from language used in the community or school. The parents, caregivers or other family members might not speak the language of the school or the community, or the parents could speak two or more languages but have made a decision about which language they speak with the child. Successive bilingualism refers to instances in which a child acquire their second language after the age of three† (Otto, 2010, pg. 71). Once they have reached the successive bilingualism stage some children learn their second language formally through school or through language classes. With successive bilingualism a child has the advantage of their first language as a base. They use this to both analyze and develop t he second. For example, the child knows that language is organized in a particular order. The more mature a child is they also have a better vocabulary base, acoustic perception, and comprehension. Therefore they would make fewer errors in a second language. For example, I once worked with a little boy, Julien, he spoke NO English when he entered my classroom (only Spanish) also, and his mom spoke NO English. As time passed he picked up English but when he got angry he would spout off in Spanish. ABSOLUTELY the cutest thing I ever saw! When parents to do not speak English I take that as a learning opportunity for myself and the parent. I try to communicate in that parent’s native language as best as I know how. Even if that means only knowing the basics. As the year progressed, the parent also learned how to speak English from taking classes on the army installation. When she could finally communicate with me she was very excited and so was I. Our relationship really grew. However, there is a critical period of learning a second language, â€Å"Many linguists believe there is a ‘critical period' (lasting roughly from birth until puberty) during which a child can easily acquire any language that he or she is regularly exposed to. Under this view, the structure of the brain changes at puberty, and after that it becomes harder to learn a new language. This means that it is much easier to learn a second language during childhood than as an adult. This is known as language interference (Otto, 2010). â€Å"Code mixing is also when the children appear to be mixing the two languages. When the children code mix this may simply reflect their parents’ use of the t wo languages. It can also reflect the attempts to maintain a conversation when knowledge of the second language is not sufficient to express the desired message. † (Otto, 2010, pg. 72). I have seen this happen on a regular basis in the preschool classroom. One incident I remember, I was joining my son for lunch and I was passing the lunch to the child next to me, when handing him the ham in the container, he replied â€Å"no bitte† which means no thank you. He said â€Å"no† in English and â€Å"thank you† in German. According to Otto, the author of Language development in Early Childhood, â€Å"Codeswitching is distinguished from code mixing and language interference by the speaker’s apparently conscious and deliberate use of two languages within the same sentence or from one sentence to another† (Otto, 2010, pg. 2) Codeswitching usually occurs when a idea label is not available in the language being used. When talking to my father he uses codeswitching all time. He would be in the middle of a conversation with me speaking to me in English and if he does not know the correct word in English he would automatically say it in Spanish . I never knew that there was a professional word for this type of language. â€Å"In the past, especially prior to 1960, bilingualism was thought to be an educational handicap† (Otto, 2010, pg. 72). It was believed that children could not learn a second language, while maintaining their first language (Otto, 2010). This is termed subtractive bilingualism. When a child encounters subtractive bilingualism this could result in the negative impact on the families. The communication between the families can become disrupted. â€Å"Prior to the 1970’s research has increased our understanding of the factors involved in second language acquisition† (Otto, 2010, pg. 73). We as educators need to get involved and help children and their amilies that are bilingual. â€Å"Current approaches to bilingualism emphasize the acquisition of the second target language, with the continued development of the home language. â€Å"This approach is also referred to the as additive bilingualism because a child’s language skills are enhanced in both languages† (Otto, 2010, pg. 73). Immersion programs promote additive bilingualism for majority language speakers. These are highl y valued educational programs. Although teaching is provided in the second language, the teacher knows and may use both languages. For example, the Child Development Center that I work for here in Hohenfels, Germany offers immersion programs to the military community. They offer German and Spanish immersion programs. I believe that these are great programs and that will be very helpful for our community, being that we have some many bilingual families in our community. Right know the classes are offered for children ranging from ages three years until twelve years of age. Also in the Hohenfels community there is Host Nation classes offered at the Elementary school. The host nation class teaches basic German words. This class also teaches the German customs. The class is offered twice a week in forty –five minute blocks. This class is very beneficial when you are in a different country. I went out to eat with my co-worker and her daughter is in the fifth grade, and just from her attending those classes twice a week she was able to order my food for me at the restaurant. I was impressed. Just being able to communicate basically and the read the menu, is what she has learned from her host nation class at school. As mentioned before, I believe the younger the child is, the better the time is to teach a child a second language. â€Å"Children who have acquired a level of fluency in two languages have been described as having the following increased language competencies: higher levels of metalinguistic awareness, greater and earlier awareness of language structure, wider perspectives, and more social skills† (Otto, 2010, pg. 73). This supports the claim of there being positive effects to bilingualism. Language is not taught directly, but it is acquired through ways which are clearly understood in a low anxiety environment. I am seeing this in my profession more and more each day. The amount of importance put onto second language acquisition is much higher that it has been before; at least it is more profound now. As a caregiver, I have learned that relationships and learning opportunities will allow children to strive in acquiring a second language. Children and families will continue to learn English as they come to the land of the â€Å"American Dream,† and caregivers, like myself will only slowly begin to see the effects second language acquisition has on our society. Persuasive Writing: Bio Chip Technology Essay

Abstract This paper focuses on the controversial subject of the human biochip through science and technology. I do not discuss the ‘Mark of the Beast’ aspect or any religious side to the topic. Some of the biochip’s first uses are explored before a possible future scenario is played out; a few points of concern are addressed and then you are introduced to Professor Kevin Warwick. I then explain how the biochip is in use today mainly as an identification device and what some possible future uses may be, such as a source of information. The paper concludes with a comparison of peoples’ feelings concerning new technology through time. Keywords: biochip, Professor Kevin Warwick A great many things are considered controversial: the death penalty, animal testing, adoption, abortion, genetic engineering, and cloning are only a few of the many subjects out there that people argue about. The biochip is an ever growing controversy that is taking many scientific and technological leaps. Though the biochip has proven beneficial in helping scientists monitor protein levels and root out cancerous cells in the human body, it has a different facet I will currently be focusing on; as an identification and a potential information device. The first use for the biochip was monitoring fisheries in the early 1980’s; it quickly moved to tagging pets, luggage, and monitoring mailed packages. Some chips are already in use in children’s backpacks and are a feature on some cellular phones, which enables parents to know where their child is at any given point in time. But the real controversy on this topic comes in with people’s concern about Big Brother. There are many misconceptions made about the biochip; some people may think that if they have one they can be found anywhere on the globe by satellite, everything about them can be found out in seconds, and that they will be controlled by the chip somehow. These statements are all untrue. The chip is so small it is only able to contain one alpha numeric series of digits to identify the holder of the chip; it doesn’t carry your name, your pin number, what car you drive, your address or anything other than the identification number. It doesn’t have enough power or range to be read or tracked by satellite. It can only be read by a scanner and only from a distance of two to twelve inches. And it in no way controls what people think or do; this concern mainly comes from conspiracy theorists. Try to imagine, you’re shopping with your kids in a large store and you turn your back for one second. The next thing you know, your youngest child is no longer with you. Through the gut wrenching panic you register the fact that there are hundreds of people around, and any one of them could have taken your child without so much as a pause in their step. Now imagine that as you entered the store, there were scanners set up at the entrance that scanned everyone as they passed. Knowing this, all you have to do is alert security about your child’s absence and they will make sure your child is still in the store. What a relief knowing that your child can be found anywhere that has a scanner to read a biochip. This scenario is still a few decades in the future, but seeing the benefits of such technology is easy. However, some downsides need to be taken into consideration as well. Say you or your child were kidnapped, what would stop the kidnapper from removing the biochip themselves to keep you or your child from being found? To keep that from happening, the biochip would have to be inserted under general anesthesia just to keep the chip safe from removal. But this process in itself is another concern; many people don’t agree with the thought of being ‘tracked’ in the first place; why would them being unconscious as the chip was placed make them feel any better? Even though many concerns can be quieted by the fact that no more information can be stored on the biochip than an identification number, who’s to say that will be the case in the future? With technology booming like it is, the next likely step in the biochip’s technology is to store more information on it. Soon, it may not be necessary to remember your car keys, your driver’s license, your social security number, or your ATM card. Before long it may be as easy as walking into a room for the lights to come on, the television to change channels, or the radio the change stations. We already see subtle changes in the way information is stored. Smart cards are used with more regularity, there are chips in breast implants, pacemakers, artificial limbs, and artificial retinas, even paraplegics have had silicon brain implants able to control computers. Professor Kevin Warwick of the University Of Reading, England is the first human biochip implant recipient. â€Å"On 20 April 1998, Professor Warwick had a glass capsule about 23 millimeters long and 3 millimeters wide†¦inserted in his left arm. The chip, in conjunction with computer equipment in his house, turns lights on and off when he enters and exits (a) room, and gives him a spoken, running tally of the mail in his email box. The chip merely sends out an identifying signal†¦but (it) is still a step forward since his body has not rejected the foreign matter.† (Mamatas 2002). It may be another decade before technology like Professor Warwick’s becomes an everyday item for everyday people, but it is easy to see how it may be as essential to us in the future as cell phones and computers are today. There are many uses and qualities in a biochip and they are already widely used in a vast number of applications: tracking cell phones, tagging pets, monitoring waste output in garbage bins in the UK, and the pharmaceutical companies are even starting to do research with the biochip technology to monitor protein levels. The next step seems to be human biochip implantation. (Chu 2005) When you compare the hesitance people felt at the thought of the social security number when it was first introduced in 1935, you can see the similarity in the concern people feel about the biochip technology today. I believe the use of this technology can be a great asset to our society and way of life no matter what application is set to use. The researchr of this essay lists down some of the professional issues that he faced during the course of his work with various companies. As Head IT Technician, the researcher was expected to plan for ongoing and regular backups of database in a particular client site. This was done twice every week at an interval of three days every time. The idea was, in case there is any data related issue, the client would be able to roll back to a state t hat was maximum three days prior to the date of the problem. The researcher also planned it in such a way that there will be at least one more backup which will also be maintained. The researcher concluds that this course made a very important point and that is: we may not be able to satisfy every one at every point in time. Professionals need to up hold the highest professional tradition and ethic. The course made the researcher to appreciate these facts of the codes of conduct as well as the ethics and the morals behind these codes.

Being a parent has matured me a lot. I now have a greater focus in life. I plan on studying for a career at a local university. I want to study in order to become more educated so I can help my kid with his school work as he continues to grow. I want to be the best parent I can for my kid.
